Thank you for your interest in and use of Calibrate IV Hydration's website, mobile app, and any content, functionality, and services offered on or through these platforms (collectively referred to as our “Platform”). The terms and conditions outlined here, along with our Privacy Policy, govern your use of our Platform, so please read them carefully before accessing or using it.

By accessing and using our Platform, you (a) acknowledge that you have read, understand, and agree to be bound by these Terms and our Privacy Policy; (b) confirm that you are of legal age to enter into a binding contract under applicable law, and that you have the right, authority, and capacity to enter into and abide by these Terms and our Privacy Policy; and (c) agree that you are legally bound by these Terms and our Privacy Policy. These Terms are non-transferable, and the access rights granted to you under this Agreement are non-transferable without the express written permission of Calibrate IV Hydration. If you do not agree to these Terms and our Privacy Policy, please refrain from using our Platform. If you are using our Platform on behalf of an entity, you agree to these Terms and our Privacy Policy on behalf of that entity and are responsible for the actions of any other person who may utilize your access rights on our Platform.

If you do not accept these Terms and/or our Privacy Policy, you are not authorized to use our Platform. We reserve the right to modify these Terms and our Privacy Policy at any time, with modifications effective upon posting to our Platform or via email notification to you. Your continued use of our Platform and/or services following any such posting or notification shall be deemed your acceptance of the modifications. Please review these Terms periodically for changes and pay attention to the “Last Updated” date displayed at the bottom of this page.

No Medical Advice; Medical Disclaimer

Our Platform allows you to request intravenous hydration services and related offerings provided by licensed medical professionals. Your use of our Platform helps identify you to the healthcare professional who will provide care. It is important to understand that Calibrate IV Hydration is not a licensed healthcare provider and is not engaged in the practice of medicine. The healthcare professional you establish a treatment relationship with is responsible for providing you with medical services, not Calibrate IV Hydration. We provide marketing, management, and technological services to licensed healthcare professionals/providers. Therefore, your use of the Platform is not intended to substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions regarding a medical condition. The information presented on our Platform is not intended as a substitute for diagnosis or treatment by a qualified physician. Additionally, Calibrate IV Hydration does not recommend changing any current medications or adding new therapies without consulting a qualified physician. Never disregard professional medical advice or delay seeking it because of something you have read on our Platform.

In case of a medical emergency, call your doctor or 911 immediately. Calibrate IV Hydration does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned on our Platform. Reliance on any information provided by Calibrate IV Hydration is solely at your own risk.

All treatments featured by Calibrate IV Hydration on the Platform are elective and intended for wellness and health maintenance only, and are not intended to treat or cure any disease.

Calibrate IV Hydration reserves the right to refuse services to anyone for any reason, regardless of any physician’s assessment.

Our Platform

Subject to your acceptance of and compliance with these Terms, Calibrate IV Hydration grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right and license to access and use our Platform in accordance with these Terms. To access our Platform, you may be required to register and maintain an active user account (your “Account”), which may include your credit card information and/or other valid payment methods. Your use of our Platform is intended for personal, non-commercial use unless otherwise authorized in writing by us. Please note that Calibrate IV Hydration reserves the right, in our sole discretion, to require valid identification before providing any services.

Collection of Your Personal Information

Calibrate IV Hydration collects personally identifiable information, such as your email address, name, home or work address, or telephone number (collectively, your “Personal Information”). We also collect anonymous demographic information, such as your ZIP code, age, gender, preferences, interests, and favorites. Additionally, we may automatically collect information about your computer and mobile device hardware and software, including your IP address, browser type, domain names, access times, and referring website addresses. This information is used for the operation of our Platform, to maintain the quality of our services, and to provide general statistics regarding the use of our Platform.

Use of Your Personal Information

Calibrate IV Hydration uses your Personal Information to (i) operate our Platform; (ii) deliver the services you have requested; and (iii) inform you of other products or services available from Calibrate IV Hydration and its affiliates. We may contact you via surveys to gather your opinions about current services or potential new services that may be offered. We do not sell, rent, or lease our customer lists to third parties. We may, from time to time, contact you on behalf of external business partners regarding particular offerings that may interest you, but your Personal Information will not be shared with those third parties. Additionally, we may share data with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. These third parties are prohibited from using your Personal Information except to provide these services to us and are required to maintain the confidentiality of your information. We keep track of the websites and pages our customers visit within our Platform to determine which services are most popular. This data is used to deliver customized content and advertising to customers whose behavior indicates interest in a particular subject area. We will disclose your Personal Information without notice only if required by law or in good faith belief that such action is necessary to: (a) comply with applicable law or legal process served on us or our Platform; (b) protect and defend the rights or property of Calibrate IV Hydration; and (c) act under exigent circumstances to protect the personal safety of users of our Platform or the public.

Consent to Use of Aggregated Data

You consent to the collection and use of technical data and related information, including technical information about your mobile device, system and application software, and peripherals. We may use this information, as long as it does not personally identify you, to improve our products or to provide services or technologies to you. The collection and use of your Personal Information in connection with our Platform will be subject to our Privacy Policy.

Technical Requirements

You are solely responsible for (a) selecting our Platform to achieve your intended results; (b) obtaining, provisioning, configuring, maintaining, paying for, and protecting from loss and damage all necessary equipment (including devices) and services for the installation and use of our Platform; (c) providing a safe and suitable location for the installation and use of our Platform; (d) using, installing, implementing, and operating our Platform and the results obtained therefrom; (e) scanning for and preventing the receipt and transmission of viruses or other harmful components; and (f) maintaining current backup and archival copies of all data on your device prior to installing or while using our Platform.

No Unlawful or Prohibited Use

You may use our Platform only (i) if you are eighteen (18) years of age or older and of the age of consent in your jurisdiction, and (ii) for lawful purposes and in compliance with applicable laws and regulations.

You further agree not to:

• Disable, damage, impede, or interfere with the functioning of our Platform, its security, its related servers or networks, or any other party’s use of our Platform.
• Alter, damage, or delete any material appearing on our Platform.
• Reverse engineer, disassemble, or decode any software embodied within our Platform.
• Rent, lend, sell, sublicense, assign, or transfer our Platform or its features to any third party.
• Circumvent any copy protection, rights management, or security features protecting our Platform.
• Threaten, harass, stalk, spam, or abuse other users.
• Engage in conduct that restricts or inhibits anyone’s use of our Platform or exposes Calibrate IV Hydration or its users to any liability.

Termination/Access Restriction

Calibrate IV Hydration reserves the right to terminate your access to our Platform and related services at any time and without notice, at its sole discretion. You may terminate your license to use our Platform at any time by notifying us in writing.

Upon termination: (i) all rights granted to you under these Terms will be terminated; (ii) you must cease all use of our Platform; and (iii) you will remain liable for all fees and obligations incurred through the date of termination. Termination of your access does not limit Calibrate IV Hydration’s rights or remedies at law or in equity.

Fees, Payment, & Refunds

You agree to pay Calibrate IV Hydration the full payment for all scheduled services at the time of booking, in accordance with our payment terms. Please note that our regenerative treatments, including stem cells and exosomes, are non-refundable. Refunds are not issued for missed appointments. To cancel an appointment, you must provide at least one hour’s notice. Failure to do so will result in a charge of the full payment amount for the scheduled services. Appointments may be canceled by sending an email to admin@calibrateiv.com or by calling 844-416-2546. Refunds will only be issued if the designated medical professional is unavailable to meet the appointment booking and cancels within four (4) hours of their scheduled arrival time.

Additionally, if the designated medical professional determines that you have misrepresented yourself regarding the information supplied via the Platform, or if you are under the influence of drugs or alcohol at the time of your appointment, they will not render the services ordered, and you will be charged the full payment amount.

Use of Communication Services

If our Platform allows you to contribute content (including uploading data, posting messages, or communicating with others), you agree to use these services only for proper and relevant purposes. You agree not to post, upload, email, transmit, distribute, or otherwise make available any content that:

1. Violates any applicable laws.
2. Restricts or inhibits any other user from using our Platform.
3. Is threatening, abusive, harassing, defamatory, obscene, or offensive.
4. Contains harmful components such as viruses or disruptive code.
5. Infringes upon the rights of others, including intellectual property rights.
6. Promotes any product or service.
7. Engages in unsolicited advertising or promotional materials (spam).
8. Provides a false identity or claims an unauthorized relationship with any business or individual.

Calibrate IV Hydration has no obligation to monitor these Communication Services but reserves the right to review and remove any materials at its discretion.

Intellectual Property

Our Platform, including its features and content, is the exclusive property of Calibrate IV Hydration and is protected by copyright and other intellectual property laws. Your use of our Platform does not grant you ownership of any intellectual property rights.

If you provide feedback or suggestions for improvements or submit materials (collectively, “Submissions”), Calibrate IV Hydration shall own all rights to these materials and may use them without restriction. By submitting your Submissions, you warrant that you own or control all rights to those materials.

Third-Party Materials

Our Platform may include third-party content or links to third-party websites or services. You acknowledge that Calibrate IV Hydration is not responsible for the accuracy or legality of these materials. Accessing them is at your own risk.

Trademarks

The names of companies and products mentioned herein may be trademarks of their respective owners. Any rights not expressly granted herein are reserved.

Liability Disclaimer

The information and services included in or available through our Platform may contain inaccuracies. Calibrate IV Hydration and/or its suppliers may make changes to our Platform at any time. Advice received via our Platform should not be relied upon for personal, medical, legal, or financial decisions.

Calibrate IV Hydration does not make any representations, warranties, or guarantees regarding the completeness, security, quality, or availability of our Platform or services. All information and services are provided "as is" without warranty of any kind.

Limitation on Liability

To the maximum extent permitted by law, the entire risk arising out of your access to and use of our Platform remains with you. In no event shall Calibrate IV Hydration or its personnel be liable for any special, indirect, or consequential damages arising from your access to or use of our Platform.

Notices and Procedure for Making Claims of Copyright Infringement

We respect the rights of intellectual property owners. If you believe any information or material violates these Terms or your copyrights, please notify us by email (Subject line: “DMCA Takedown Request”) or by mail at the address specified below.

Indemnification

You agree to defend, indemnify, and hold harmless Calibrate IV Hydration and its affiliates, employees, agents, and representatives from any claims, damages, costs, and liabilities arising out of your use of our Platform or your breach of these Terms.
